PRIVACY POLICY

  1. INTRODUCTION


    Pioneer Electronics Australia Pty Ltd (ACN 005 017 087) (including any affiliates and associate companies), (hereinafter referred to as “Pioneer” or “us”, and terms of similar meaning) is engaged in the business of connected intelligent devices and their associated web-based or mobile based applications. In doing so, it is essential that people's privacy is protected through the lawful and appropriate use and handling of their personal information. This Pioneer privacy policy describes our practices in connection with information privacy on Personal Data (as hereinafter defined) we process through your access and use of our Products and Services (as defined below) and their connected intelligent devices.

    Our Services (as defined below) are available for use by our customers (those who actively use our Services, in conjunction with our Products), and visitors (those who browse our website for informational purposes) (both customers and visitors, are hereinafter referred to as “end-user” or “you” and terms of similar meaning). The use, access, installation or general exploration of our products and services states that you expressly consent to our and our trusted business and authorized partners' collection, storage, use, processing and disclosure of the Personal Data in accordance with the terms of this privacy policy. You are not obliged to provide to us your Personal Data, however, if you decline to provide such data, you would no longer be permitted to access our Services. We will not be liable and/or responsible for the denial of providing access to any products and services to you on account of inadequacy of information provided by you.


  2. AIM


    This policy aims to protect Personal Data of the various stakeholders connected to us. This Policy sets forth the basic principles by which we process the Personal Data of our customers and visitors, and indicates the responsibilities of our business departments and employees while processing such Personal Data.

    This privacy policy between Pioneer and you (the “Privacy Policy”) outlines how your Personal Data will be collected, used, processed and shared in connection with your access to and/or use of our Products and Services as described in detail herein below.


    Additionally, this Privacy Policy forms part and parcel of our terms and conditions under the agreement to use (Agreement) and the limited warranty statements (“Limited Warranty Statement”) which is included herein by this reference and can be specifically accessed at respective product support page.


    This Privacy Policy applies only to information collected by us or our trusted and authorized partners and not to information collected offline or through the websites of our third party business partners or corporate affiliates, even if their websites or services/ skills are linked to our products and services. We recommend that you review the respective privacy statements of all the third parties with whom you interact.


    The terms (whether capitalized or not) which have been used herein but are not specifically defined shall have the same meaning as attributed to such term in the Agreement or the Limited Warranty Statement.

    The Agreement, the Limited Warranty Statement and this Privacy Policy are to be interpreted harmoniously at all events.


  3. SCOPE


    For the purposes of this Privacy Policy, we determine the type, purposes, conditions and means of processing of your Personal Data (defined below) as per the Applicable Law. For the purposes of clarity, this Privacy Policy published and provided to you herein is an electronic record generated by a computer system and does not require your physical or digital signatures.


    This Privacy Policy encompasses the processing of your Personal Data shared via:

    1. Our website “https://www.pioneer.com.au/” (“Site” or “Website”),

    2. Our product(s), as mentioned in our portfolio online or offline (through trusted and authorized business partners), including but not limited to the infotainment systems range, and dashcam range, and parts, components, accessories for the same (“Products”),

    3. Our services, including any free or paid subscription-based services offered by us online or offline (through our trusted and authorized business partners), software services, technical support and services accessible through our Products, softwares such as mobile or personal computer applications and/ or Website and application including the applications for our dashcam Products such as the mobile application for accessing the dashcam recordings (Dashcam App) and other applications associated with our Products (“Services”).

      Our Products and Services are intended for personal/non-commercial usage only and is not to be used for commercial purposes. The usage and access of the Products and Services for commercial purposes by an individual(s), group(s) or third parties, other than our Affiliates will not be a responsibility of or impose any liability or obligation on Pioneer, or our Affiliates. Any amendments or revisions to this Privacy Policy will be notified to you in accordance with the Applicable Law.


      Our Products and Services are intended for use within Australia and New Zealand only. The usage and access of Products and Services outside Australia or New Zealand by an individual(s), group(s) or third parties, and associated actions will not be a responsibility of or impose any liability or obligation on Pioneer, or our Affiliates.


  4. DEFINITIONS


    The terms and expressions used in this Privacy Policy shall have the meaning ascribed in this section, or as provided by way of inclusion of quotations or parentheses.


    Affiliates” shall mean affiliates, associates, subsidiaries, business partners and authorized partners of Pioneer.


    Applicable Law” shall mean the Privacy Act 1988 (Cth), the Privacy Regulations 2013 (Cth) and any other applicable statute, enactment, law, by-law, rule, regulation, order, ordinance, guideline, policy, judgements, decree, or any similar form of decision of, or determination by, or any interpretation having the force of law, of any governmental authority of Australia or New Zealand, having jurisdiction over the matter or you or us, whether in effect on the implementation date of this Privacy Policy or thereafter.

    Personal Data” means a representation of information, facts, concepts, opinions or instructions generated, collected, recorded and/or stored, electronically or otherwise, in a manner suitable for communication, interpretation or processing by human beings or by automated means that can be used to identify an individual or reflect the activity of an individual, either from that information alone, or from that information and other information we have access to about that individual. Personal Data shall include all information that can be linked to a specific individual or used to identify any individual, such as

    1. name (such as first, middle (if any) and last name);

    2. employee record information;

    3. transaction details (such as delivery information, billing and account details and payment card details);

    4. customer service, and enquiries, including any information collected in processing an enquiry made by you;

    5. contact data (such as your e-mail address, phone number and account details);

    6. physical/postal address (such as your home or work address);

    7. demographic data (such as your name, gender, age group and date of birth);

    8. details of consents (records of consents given with the date and time and other relevant information); and

    9. any and all details that may be necessary from the user.


      Please note that the above list is not an exhaustive list and is only an illustrative list.


      Third Party Service(s)” means applications and/ or services (currently available or as may be available in the future) provided by any third party, including without limitation, the voice services, that may be used or availed by you through or during usage of the Products and Services.


      Sensitive Personal Data” means such Personal Data which consists of information relating to personal biometric information, passwords, communication records, financial information such as Bank account or credit card or debit card or other payment instrument details, medical records and health information, transaction information, sexual orientation etc., according to various the Data Protection Laws. When we collect Sensitive Personal Data from you, we will generate an explicit notification for your consent before we collect Sensitive Personal Data about you.


      Data Protection Laws” refers to the data and privacy protection laws applicable in Australia and New Zealand, including the Privacy Act 1988 (Cth), and the and requirements under the Spam Act 2003 (Cth) (together the “AU Privacy Law”), and their equivalent counterparts in New Zealand, including the Privacy Act 2020 (New Zealand).

      “Data Fiduciary” means any person who alone or in conjunction with other persons determines the purpose and means of processing of personal data;


      Data Processor” means any person who processes personal data on behalf of a Data Fiduciary;


      Processing” in relation to personal data, means a wholly or partly automated operation or set of operations performed on digital personal data, and includes operations such as collection, recording, organisation, structuring, storage, adaptation, retrieval, use, alignment or combination, indexing, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction.

      “Usage Data” is data collected automatically and either generated through use of the Services or from the infrastructure underpinning the Services.


  5. DEFINITIONS (BODIES AND LAWS)


    Australian Privacy Principles (APP)” reference to APP in this policy means the Australian Privacy Principles contained in Schedule 1 of the Privacy Act 188 (Cth). These APPs govern the content of privacy policies and rights under Australian law. We take pride in our adherence to these Principles.

    “Information Privacy Principles (IPP)” reference to the IPP in this policy means the New Zealand Information Privacy Principles contained in the Privacy Act 2020 (New Zealand). These IPPs govern the content of privacy policies and rights under New Zealand law. We take pride in our adherence to these principles.   6. USER REPRESENTATIONS AND WARRANTIES


    By using and accessing our website, products, services, web apps, mobile apps and other services, accessing our platforms and/ or by providing your information, you represent and warrant as follows:

    1. You are of the legal age under the Applicable Law

    2. You have the lawful authority and capacity to contract and be bound by this Privacy Policy.

    3. If you are accepting this Privacy Policy on behalf of a company, limited liability partnership or other legal entity, you have the authority to bind such entity to this Privacy Policy and, in such event, “you” and “your” as used in this Privacy Policy shall refer to such entity;

    4. You will comply with Applicable Law; and

    5. You shall provide accurate, current, and complete information as may be prompted (i.e., registration and user account details) and maintain and undertake to update the same in respect of any changes.

    We collect certain Personal Data, non-personal data and other information and correspondences from you, that we consider are necessary for providing you access to our Products and Services. The Personal Data we collect from users helps us in personalizing and regularly improving your experience and helps us to understand the user profile using our products or services.

    We may use your Personal Data to contact you with notifications, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by turning off notifications within the website or following the unsubscribe link and the instructions provided in any correspondence we send.


    We do not collect or otherwise process Personal Data about race, religion, sexual orientation, payment or health or any other information that may be deemed to be Sensitive Personal Data under the Data Protection Laws in the ordinary course of our business.


    Any content on the website or other public platform shared by you via reviews, comments, blogs, discussion boards, forums, user testimonials, scribbles, etc., becomes published content and are not considered as Personal Data and is not protected by Pioneer. You are responsible for any third-party Personal Data obtained, published or shared through the use of the website or mobile app and confirm that you have such third party's consent to provide such information to us.


    When you visit the website or access our software Services, relevant non-personal information may be collected such as domain and host from which you access the internet, your internet protocol (IP) address, operating system, browser type and browser version, internet service provider, the screens and interfaces within our Service that you visit, the time and date of your visit, the time spent on those interfaces, unique device identifiers (like any device ID), device type, mobile device information such as mobile device model number, IP address, wireless connection information, the type and version of the operating system, application version number, log files, precise mobile location, mobile network information, and other diagnostic data. In order to ensure the security of the operating environment or to provide services, we will collect information about the installed mobile applications and other software you use.

    We may also be collecting Personal Data through our Products and Services or otherwise. Such data may be backed up to the cloud (i.e., our own cloud software and/ or other third-party cloud services) and may be retrieved or restored from such cloud. Such data collected may be used for various purposes set out below.


  8. PERSONAL DATA COLLECTED DIRECTLY FROM YOU


    We may collect your Personal Data through various means, as described below.


    Log In/Registration


    To initiate an account for the use of Products and Services, through web-based applications and mobile applications, users are required to provide certain Personal Data voluntarily. This information is used to process requests, respond to questions, and customize user experiences based on data such as age group, gender, and consumer habits. In this process, we may collect certain information from you with respect to your registration or login details such as username, email, phone number and password, along with other account formation details that may be required to identify a particular account to you and your purchased Products. While users can choose not to supply some information, it may limit access to certain features. Shared information is also used to streamline services and, if necessary, may be shared with trusted intermediaries for processing orders and fulfilling services.

    Videos


    Our Products may capture, process and store videos that are made by you for various time periods depending on the device configuration and settings adopted by you. Pioneer and its Affiliates do not use or modify these captured videos in any way. The video data as captured through the Products is only accessible by you through your registered account with your express consent. Additional Personal Data might be required in case you are trying to post or upload via the website or mobile apps or web apps in a personal or public circle such as sending an invite to your family or friends or posting the original copies or modified copies of your videos on social platforms.


    Customer Service


    We may collect information through our customer support team or communications team that you have shared voluntarily such as product serial code, usage details, warranty details, purchase invoice, etc.


    Correspondences


    When you send emails or other communications to us, we may retain those communications in order to process your inquiries, respond to your requests and improve our platform, Products and other Services. Further, the email address you provide for application login (in relation to product(s) purchased), may be used to send you occasional company news, updates, related product or service information, etc.


  9. PERSONAL DATA COLLECTED BY US INDIRECTLY, WHEN YOU USE, ACCESS AND ADOPT OUR PRODUCTS AND SERVICES


    Analytics Information/ Data


    Certain information is collected and processed with your usage of the website and mobile apps, such as log files, number of visitors on the website or app, website or app traffic, preferences, interests or other non-

    identifying statistics. When you onboard via your smartphone or tablet to the Pioneer Platform and the Dashcam App, we might collect and analyse details including but not limited to IP address, device ID, and others along with the functionality of automated data tracking technologies like cookies. Our servers will log IP addresses and collect any third- party websites and related information via our End User's use of the website.


    Product Usage


    Pioneer collects information related to the use of our Products and devices by End Users. We also collect data on the performance of our Products and other devices, their parts/ components/ accessories thereof.


    Mobile Device


    In case you are accessing Pioneer Platform or the Services, including services from the Dashcam App on your device including, but not limited to, smartphones or tablets, then certain Personal Data might be accessed like your location and your contact list as per our terms and conditions. You can choose to not share the details in which case certain functionalities will be disabled.


  10. PERSONAL DATA COLLECTED FROM OTHER SOURCES


    Social Networking Websites


    If users register or log in through social networking websites, Pioneer can access their basic profile information as allowed by their privacy settings. Users must understand that these social networking sites have their own privacy policies, which Pioneer cannot control. Once users leave Pioneer Website or the Dashcam App or link their accounts to third-party websites, the privacy policies of those websites govern the use of any Personal Data, which may differ from this Privacy Policy.


    Pioneer is not responsible for any information/ Personal Data collected from you by third parties (including those providing any Third Party Services) and you are required to carefully review and update yourself with the terms and conditions imposed by and privacy policies and disclaimers set forth by such third parties.


    Third Party Website Links and Services


    We may provide links to some external third-party websites. The provision of any such link does not mean promotion or endorsement of the external website, website or websites, or the product and services offered by it. We do not share any personal information on behalf of our users who choose to visit these websites. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

    We strongly advise you to review the privacy policy of every site you visit.


  11. HOW IS THE INFORMATION USED?


    The sole purpose of the use of the Personal Data shared by you is to provide you with a better product experience, continually improve the services offered by Pioneer Platform and other applications and smoothen your experience as a user. We may use your Personal Data shared with us for following purposes:

    1. we may use the Personal Data to communicate with you to personalize and improve the Products and Services experience and process and fulfil Your requests (if any), to customise our

      communication with you through the marketing material/ advertisement we and our Affiliates share with you;

    2. for undertaking market analysis including relating to consumer and usage patterns;

    3. for providing Products and Services and access thereto, we may disclose your Personal Data to our Affiliates (as applicable and if required for the purposes of our legitimate business interest), which may be located outside Australia or New Zealand, including Japan, Singapore and the United States of America;

    4. to improve our Products/ devices, provide requisite upgrades and customizations and other associated services to improve user experience and interaction and provide you with best possible services;

    5. for mapping and monitoring various performance affecting parameters including but not limited to internet speed, voltage, camera performance, storage information, or error tracking;

    6. for analytics purpose to understand how our Products and Services are being used, viewership of our Products and Services and access of the Pioneer Platform and the Dashcam App;

    7. to ensure smooth functioning of our Products and Services, and provide customer support to take continuous feedback in order to improve our existing services or provide our users with any specific customized service offered by our product;

    8. for safekeeping, safety, security and integrity of the Company, website, any platforms, applications and customers;

    9. as and when required by the Applicable Law, extending claim or jurisdiction over the Company or our associates,

    10. to maintain your account with us and provide you with a customized service based on your preferences;

    11. enhancing your usage experience;

    12. administering and processing your requests;

    13. to enforce this Privacy Policy;

    14. To publish any testimonials or reviews that you may have provided on our websites and other online platform;

    15. undertaking marketing and promotion of targeted and selected goods and services to you based on your use of products, services, applications and your consumption patterns;

    16. any other specific purpose in which case your consent will be asked before using your Personal Data, and

    17. for any other purpose to give effect to the abovementioned.


      We may keep using your data for advertising and communication purposes until you actively withdraw consent for the same. Please be informed that you have the right to withdraw consent from such advertising contents and you can exercise it at any moment.


  12. HOW IS THE INFORMATION SHARED?


    We do not share, disclose, sell or otherwise trade in any information or Personal Data provided by you with other persons/ entities or any third-party affiliates except for the purposes of our legitimate business interests and to facilitate your requested Services based on the Personal Data shared by you voluntarily to:

    1. provide services to you based on your use of products, services, applications and your consumption patterns,

    2. To enable you to access and use our Services (on the grounds of fulfilment of our contract with you);

    3. To operate, maintain, protect, improve, and optimise our Services (on the grounds of fulfilment of our contract with you);

    4. To notify you about changes to our Services (on the grounds of our legitimate interests in ensuring you are aware of any relevant changes);

    5. To allow you to participate in interactive features of our Services when you choose to do so (on the grounds of your consent);

    6. To provide or administer rewards, surveys, contests, or other promotional activities or events;

    7. To provide customer support (on the grounds of our legitimate interests in ensuring you receive the help you need when accessing our Services);

    8. To gather analysis or valuable information so that we can improve our Services;

    9. To monitor the usage of our Services;

      Further, we may share, disclose or transfer your Personal Data:

For legitimate business purposes (including but not limited to operating and upgrading our devices, products and services, our online platforms, conducting our business, our employees, related bodies corporate or providing any service to you), in accordance with Applicable Law, with our Affiliates or trusted third parties who will ensure the same standards of securing of Personal Data.

      2. If we believe such disclosure/sharing is necessary to (i) comply with the Applicable Law; (ii) enforce our online Pioneer Platform policies, this Privacy Policy, conducting investigation of potential violations thereof, the Agreement to Use and the Limited Warranty Statement; (iii) protect our devices/ products/ services security, information of other end-users, or protect ours or others' rights, property, or safety; (iv) detect, prevent, or otherwise address fraud, security or technical issues; or (v) protect against imminent harm to the rights, property or safety of Pioneer or its Affiliates and our users where such disclosure is required or permitted under the Applicable Law.

      3. To experts and professional advisors (such as accountants, auditors, or lawyers), subject to binding contractual obligations of strict confidentiality and non-disclosure.

      4. When Pioneer is being acquired by another entity or is undergoing a merger with another entity. In any such scenario, Pioneer will notify you before the Personal Data is shared or transferred. It also implies that any further services and interactions will be subject to an amended or new privacy policy that you will be required to consent to.

      5. When we believe it is necessary to share the Personal Data in order to control, investigate or take appropriate action regarding any illegal activity, fraud or any situation involving or causing any potential threat to the safety of any person(s), entity(ies) or group(s), as and when required under the Applicable Law, or in case of violation of our policy statement or terms of service.

      6. In any other situation in which case we will seek prior consent from you before sharing, disclosing or transferring such Personal Data to any third party.

      7. Payment system operators (for example, merchants receiving card payments).

      8. Our existing potential agents, business partners or partners.

      9. Our sponsors or promoters of any competition that we conduct via our services

      10. Other persons including government agencies, regulatory bodies, and law enforcement agencies and as otherwise permitted by law.

      In general, we do not sell any Personal Data to third parties. If we participate in a collaboration with a third party which involves collecting data and you subscribe to a mailing list associated with this collaboration, your Personal Data may be transferred to this third party so that they may send you marketing in accordance with the consent you provided. Your data will only be given to the core third party involved in the associated collaboration.

      We will only disclose data to third parties where such disclosure is, in the course of providing the Services, reasonable (including publicly available) or required by law – see below for more details.


  13. YOUR RIGHTS AND DUTIES UNDER THE PRIVACY POLICY


    The Personal Data will be processed in recognition of an individuals' data protection rights. You will have a right to access (a) summary of Personal Data processed by us and the processing activities undertaken by us; (b) identities of all entities with who the Personal Data has been shared except in case wherein the Personal Data has been shared with a third party authorised under Applicable Law to obtain the same for the purpose of prevention, investigation or prosecution of offences. You may request updates, revision or erasure of the Personal Data shared by you. You may address all your grievances with respect to this Privacy Policy through the grievance redressal mechanism set out under this Privacy Policy.

    You agree to (a) comply with the Applicable Law; (b) not impersonate another person while providing Personal Data; (c) not supress material information; (d) not register false or frivolous complaints; and (e) furnish only such Personal Data as is verifiably authentic.


    You are responsible for maintaining the security and confidentiality of your user id and password while using and accessing our products, services and applications. You acknowledge that neither we nor any of our Affiliates, our directors or shareholders shall be liable to you under any circumstances for any direct, indirect, punitive, incidental, special or consequential damages that result from or arise out of, or a breach or, or compromise of registration of your user account with us and/or your ability or inability to use the user account.

    You agree and undertake that any information you share on our Website or applications or with your friends and family via the applications will be your responsibility and consequently you shall be imposed with related obligations and liability thereof. We are also not responsible for any Personal Data you share in any external groups, forums or discussions which are public in nature whether such information has been shared on or through our Website, and applications or any of our authorized third party platform(s) and tool(s).


  14. LAWFUL BASIS FOR PROCESSING INFORMATION


    As outlined in this Privacy Policy, we will not process Personal Data without a lawful basis to do so and except for the purposes of legitimate business interest. We may process Personal Data on the legal basis:


    1. Where you have given consent (where we have obtained your prior, free, unambiguous, clear, indistinguishable, express consent to the processing);

    2. To fulfil our contract with you (in case of your contractual agreement to processing of data set out under this Privacy Policy; and if you have entered into an agreement with us and such processing is a necessary part thereof for the purposes of legitimate business interest);

    3. To comply with the Applicable Laws;

    4. To comply with any legal obligation;

    5. To take measures to provide medical treatment or health services to any individual during an epidemic, outbreak of disease, or any other threat to public health;

    6. To take measures to ensure safety of, or provide assistance or services to, any individual during any disaster, or any breakdown of public order;

    7. To protect and defend our rights or property;

    8. To prevent or investigate possible wrongdoing in connection with the Service; and

    9. To protect against legal liability.


      Further, we may also process certain Personal Data on the basis of the following legitimate business interests, provided that such interests are not overridden by your data protection and privacy rights and interests: (i) delivering the purchased Products and Services or other associated/ linked service requested by you; (ii) analyse and suggest if any other related Product/ Service shall be suitable for you to improve, personalize and customize your user experience; (iii) developing and continuing to develop, upgrade and improve our products and services, our website, our online and other platform(s), learning from your user/ media consumption behaviour to better serve you and other users; (iv) helping us modify, upgrade, customize and/ or enhance our Products and Services, our website, our online and other platform(s) (online or otherwise), mobile app and web app, software, and its content(s)/ service(s), receiving insight as to what users like or dislike, prefer, their habits and patterns in respect of viewing or aspects thereof; (v) providing a consistent and secure user experience in connection with our products and services, our website, our online and other platform(s), software and its content(s), any application, other associated/ linked services, mobile app and web app; and (vi) analytical purposes.


  15. RETENTION OF INFORMATION


    We retain Personal Data and other information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with the Applicable Law. Notwithstanding the above, we may choose to delete the Personal Data shared by the user(s) in case the information is no longer required to carry out our legitimate business interests and the purposes for which we were processing the information. Generally, all data on our servers is archived for 7 years. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

    On receiving a request to discontinue the Services or deactivation of the user account, we will delete the Personal Data unless we are required to retain the same for further processing by Applicable Law . In case of account/ service deletion or data purging, no backups shall be made in our systems/ servers/ networks whatsoever, at our sole discretion only. We may choose to keep the information in a form which does not permit identifying you personally.


    We subject our cloud databases to periodic reviews and updates to gather information which is obsolete and no longer needs to be retained based on certain time periods, taking into account the type of Service the user is offered, the duration of our relationship with you, the customized service requested by you, necessary retention periods, and following the specified terms and conditions and the provisions of this Privacy Policy.

    We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

    In general, we will only retain data for as long as necessary.

As this data should only be accessible by us (and the cloud-storage provider, to the extent it is for legitimate maintenance and support reasons) the information contained in the data is stored in Australia, as it is only at this location where the data packets can be compiled to reveal the information.

    3. The contract between the third-party provider and us incorporates the Standard Contractual Clauses (as issued by the Commissioner in the Commission Implementation Decision (EU) 2021/914) and any transfers between the third-party provider and us is in accordance with these Standard Contractual Clauses.

      We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services, or assist us in analysing how our Service is used.

      Data is currently stored on:

      1. physical data servers on servers and computes located in Australia.

      2. IT service providers for assistance with data hosting, located in the United States of America and the United Kingdom.

      3. IT service providers for administrative applications and website functions, located in Singapore.

      4. Service providers for marketing functions and promotions, located in the United Kingdom and Ireland.

      5. Service providers for recruitment services, and workforce management, located in the United Kingdom, the United States of America, Singapore, Hong Kong, and the Philippines.

      By submitting your Personal Information or Personal Data to Pioneer, you expressly agree and consent to the disclosure, transfer, storing or processing of your or Personal Data outside of Australia. In providing this consent, you understand and acknowledge that countries outside Australia do not always have the same privacy protection obligations as Australia in relation to Personal Information or Personal Data.


  17. ACCESSING, UPDATING AND DELETING YOUR INFORMATION


    As a user of our Products and Services range, you may at any time access, correct, delete, change or transfer your Personal Data that we hold, including registration and account details. Additionally, you may at any time access, delete or change the subscribed services you have opted for. You can update or modify the Personal Data you have included in your profile or change your username by logging in and accessing your account.


    If required by you, we will delete the Personal Data provided by you in connection with use and access of our Products and Services and all associated/ linked services/ content, including applications, software, etc, provided to you.


    We may retain Personal Data about you for the purposes authorized under this Privacy Policy, the Agreement to Use and the Limited Warranty Statement and/ or other disclaimers or statements thereof, unless prohibited by the Applicable Law. Thereafter, we will either delete your Personal Data or de-identify it so that it is anonymous and not attributed to your identity, provided this may affect your use and access to your purchased products and services, software, applications and its associated/ linked services and content may be disabled, discontinued, non-usable and may not be available.

    Though you may delete your account, you acknowledge that we may retain certain residual information in connection with your account including but not limited to subscriber related information, payment details and complaints related data (if any). We shall retain such residual information for our record even after the deletion of your account associated with us and/ or any authorized third party partner(s) only in consonance with this Privacy Policy, the Agreement to Use and the Limited Warranty Statement and/ or other disclaimers or statements thereof, including for the purpose of compliance with legal obligations, resolving of disputes and enforcing of agreements.

    We are very particular and diligent about the user experience of our end users and ensure proper safeguards to protect the Personal Data they entrust to us.     We host all our products, services, applications, software, platforms and utilize cloud services (i.e., our cloud services and other trusted third party cloud services) in a protected manner in accordance with Applicable Law by utilizing a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders.


    Please bear in mind that that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.


  19. CAN CHILDREN ACCESS THE PRODUCTS AND SERVICES?


    Our products and services are only to be used by adults or with the consent of your parents or guardians. Any discrepancies arising out of any unsupervised usage of our products or services will not be our responsibility and consequently any imposition of obligations or liability thereof shall not be attributable to us.
